Terms of Service
These Terms govern all services provided by CasStudio, including shadow diagrams, daylight/sunlight and solar access assessments, 3D visualisation, and point cloud to BIM documentation ("Services"). By accepting a quote or instructing us to proceed, you agree to these Terms.
1. Quotes and Engagement
1.1.All work is quoted as a fixed price in writing (GBP, AUD, EUR or CHF), based on the drawings, documentation and scope you provide.
1.2.A quote is valid for 30 days. Work begins once you confirm acceptance in writing (email is sufficient) and we have received the required project inputs.
1.3.The quoted price covers the scope described in the quote. Work outside that scope — including design changes to the proposed building, additional dates or times of analysis, additional viewpoints, or reconstruction of geometry from undimensioned documents — is quoted separately before we proceed.
2. Client Inputs
2.1.Our analysis is produced from the drawings, surveys, site data and instructions you supply. You are responsible for the accuracy and completeness of these inputs, including building heights, boundary positions, levels and neighbouring context.
2.2.Where inputs are incomplete, we will tell you what is missing before quoting. If inaccurate inputs are discovered after work has begun, corrections are treated as a new revision or a re-scope, depending on extent.
2.3.You confirm you have the right to supply the drawings and documents you send us, and that our use of them for the engagement does not infringe any third party's rights.
3. Deliverables, Revisions and Turnaround
3.1.Deliverables are defined in the quote and typically include print-ready PDF documents, a methodology statement, and DWG/ArchiCAD source files.
3.2.One revision round is included in every fixed price, covering presentation adjustments within the agreed scope. If the assessing council or planning authority returns the document with a compliance query, one further compliance revision is included at no additional charge. Revisions arising from changes to the building design are quoted separately.
3.3.Turnaround times stated on our website and in quotes (e.g. first working draft within 48 hours) are counted in working days from receipt of complete inputs and confirmed scope. We take deadlines seriously; however, turnaround commitments are estimates, not guarantees, where inputs arrive late or incomplete.
4. Planning Outcomes — Important
4.1.Our documents are prepared with professional care against the applicable standard (e.g. BRE 209, the relevant local planning scheme, the NSW Apartment Design Guide, ResCode, WA R-Codes) as identified in the quote.
4.2.We do not and cannot guarantee planning approval, DA consent, or any decision by a council, planning authority, certifier, tribunal or court. Planning decisions rest with the relevant authority and depend on factors beyond the documents we produce.
4.3.Our assessments are technical planning documents. They are not legal advice, and daylight/sunlight assessments do not constitute Rights of Light advice (a separate legal matter in the UK).
5. Fees and Payment
5.1.Unless agreed otherwise in the quote, invoices are payable within 14 days of issue.
5.2.For first engagements or larger projects we may request a deposit before work begins; this will be stated in the quote.
5.3.Final source files and any licence under clause 6 transfer on receipt of full payment. We may withhold final deliverables until payment is received.
5.4.Late payments may attract statutory interest and suspension of ongoing work after written notice.
6. Intellectual Property
6.1.On full payment, you receive ownership of the project deliverables (the PDF documents, diagrams and reports produced for your project) for use in your planning submission and related project purposes.
6.2.We retain ownership of our working methods, templates, scripts, model libraries and know-how used to produce the deliverables.
6.3.Unless you instruct us otherwise in writing, we may display anonymised excerpts of completed work (without client names, addresses redacted where sensitive) in our portfolio and marketing.
6.4.Drawings and documents you supply remain your (or your client's) property; we use them only to perform the Services.
7. Confidentiality
7.1.We treat all project materials, addresses, and commercial terms as confidential and do not disclose them to third parties except as needed to perform the Services or as required by law.
7.2.Where you act as an intermediary or reseller, we do not contact your end client without your consent.
8. Liability
8.1.Nothing in these Terms excludes liability that cannot lawfully be excluded.
8.2.Subject to 8.1, our total aggregate liability arising out of or in connection with an engagement is limited to the fees paid for that engagement.
8.3.We are not liable for indirect or consequential loss, including loss of profit, loss of development opportunity, delay costs, or decisions made by planning authorities.
8.4.Deliverables are prepared for the project and purpose stated in the quote. Reuse on another site, scheme revision, or application is at your risk unless we re-verify the analysis.
9. Cancellation
9.1.You may cancel an engagement in writing at any time. Work completed up to the cancellation date is invoiced proportionally; any deposit is applied against that amount.
9.2.We may terminate an engagement where inputs necessary to proceed are not provided within 60 days, or where invoices remain unpaid after notice.
10. General
10.1.These Terms, together with the written quote, form the entire agreement for the engagement and supersede prior discussions.
10.2.These Terms are governed by the laws of the Republic of North Macedonia, and disputes are subject to the jurisdiction of its courts, unless otherwise agreed in writing for a specific engagement.
10.3.If any clause is found unenforceable, the remainder continues in effect.
10.4.We may update these Terms from time to time; the version in force when you accept a quote applies to that engagement.
