BRE 209 Explained: VSC, APSH and NSL for Non-Specialists

What is BRE 209?

BRE 209 — formally “Site Layout Planning for Daylight and Sunlight: A Guide to Good Practice” — is the guidance document UK local planning authorities use to assess how a new development affects daylight and sunlight to neighbouring properties. It was published by the Building Research Establishment, most recently updated in 2022, and it’s referenced (directly or indirectly) in the majority of UK local plan policies covering daylight and sunlight.

BRE 209 isn’t a law and its thresholds aren’t mandatory pass/fail rules — the guide itself says as much. But in practice, planning officers use its three core metrics as the working standard for whether a scheme’s impact on a neighbour’s daylight or sunlight is acceptable.

The three metrics: VSC, APSH and NSL

VSC — Vertical Sky Component

VSC measures how much of the sky is visible from the centre of a window — in other words, how much daylight potential that window has. It’s expressed as a percentage. BRE 209 suggests that if a window retains a VSC of 27% or more, it has adequate daylight. If a proposed development reduces a neighbouring window’s VSC to less than 0.8 times its former value (a drop of more than 20%), the reduction may be noticeable to the people living there.

APSH — Annual Probable Sunlight Hours

APSH measures sunlight, not daylight — specifically, the hours of direct sun a window is likely to receive over a year. It only applies to main living room windows facing within 90 degrees of due south (since north-facing windows never get direct sun regardless of what’s built nearby). BRE 209’s guidance is that a window should retain at least 25% of annual probable sunlight hours, including at least 5% during the winter months (21 September to 21 March).

NSL — No Sky Line

NSL looks inside the room, not just at the window. It divides the room’s working plane — typically measured at 0.85m height, desk height — into the area that can “see” a patch of sky and the area that can’t. If the daylit portion of the room shrinks to less than 0.8 times its previous size because of a new development next door, that’s considered a noticeable reduction under BRE 209.

Which metric applies to my project?

This depends on what’s being assessed and what the neighbouring windows are used for:

  • Assessing impact on existing neighbouring windows — usually VSC (and NSL for the room behind it)
  • Assessing impact on main living rooms specifically — APSH becomes relevant alongside VSC
  • Assessing daylight within a proposed new building (not just neighbour impact) — a related but separate calculation, Average Daylight Factor (ADF), sometimes required under BS EN 17037

Most standard householder extensions only need VSC calculated for a handful of directly affected neighbouring windows. Larger and taller schemes — especially those affecting multiple properties — typically need the full set: VSC, APSH and NSL, reported per window, with an explicit pass/fail statement referenced to BRE 209.

A common misconception: BRE 209 vs Right to Light

These two are frequently confused, but they are legally distinct:

  • BRE 209 daylight/sunlight assessment is a planning matter. It’s assessed by the local planning authority as part of a planning application, and a scheme that satisfies BRE 209 is considered acceptable for planning purposes.
  • Right to Light is a civil law matter — a private property right that can be acquired over time (typically 20 years of uninterrupted enjoyment of light through a defined aperture). It’s a dispute between neighbouring landowners, not something the planning authority rules on.

A development can fully satisfy BRE 209 for planning purposes and still face a separate Right to Light claim from a neighbour — the two systems don’t automatically align. If Right to Light is a live concern on your project, that needs a solicitor or a Right to Light surveyor, not a standard BRE 209 planning assessment.
